General Information

International Agreements : Paris Convention and Madrid Treaty.

Patent Types : Convention and non-convention.

Novelty Requirements : Inventions must be novel in that they have not received sufficient publicity in Malta or abroad, not more than 12 months.

Claiming priority : Yes
Examination : Yes - only for formal formalities - not for technical content. 
Protection Period : 20 years from filing date.
Publication : Yes – but not before 18 months from the priority date.

Annuity Payments : The first annuity for the Fifth (5) year is payable before the expiration of the 4th year. Annuity fees are then paid every year thereafter, always payable before the expiration of each year.

Notes : 

  • Assignments are recorded after grant.
  • A patent is granted about 12 months after application in Malta.
  • Applications in Malta are filed in English so any non-English documents must carry a certified English translation. This can be filed within 60 days.
