Trademarks: Antigua & Barbuda
General Information
A Trademark can be registered in Antigua & Barbuda in two ways:
- Either pursuant to the Trade Mark Act (2003) which provides for local
Trademark applications dating from receipt of application.
- Or pursuant to the registration of United Kingdom Trade Mark Act (1946) which
provides for applications to extend rights under a UK registration with effect
from the date of registration in the UK.
Classification : The International Classification is used. Multi-Class applications are allowed.
What is Registrable : Service Marks are permitted BUT can only be registered by
an application to extend rights under a UK registration.
Priority under Paris Convention : Yes
Time Frame for Registration : 12 Months
Registration Term : 10 Years - a UK based trademark registration is valid for the
same period shown on the UK registration certificate
Renewal Term : 10 Years –a UK based registration can only be renewed if the
underlying UK registration has been renewed.
Grace Period for Renewals : Yes – 6 months with late payment fees.
Assignments - Must Assignments be recorded ? Yes
Important Notes : Multi-Class applications are allowed. A UK based application, however, is restricted to the number of classes specified on the UK Certificate.

- Full details of the mark & class(es).
- Certified copy of UK Registration Certificate showing the Renewal (only for UK
based registrations).
Assignment Recordal Requirements
- Power of Attorney Notarized.
- Full details of the mark & class(es).
- Assignment Deed Notarized.
- A Declaration verifying Assignment Notarized.
- Certified copy of the UK Registration Certificate showing the Assignment (only
for UK based registrations).
Change of Name/Address Requirements
- Power of Attorney Notarized.
- Full details of the mark & class(es).
- Certificate documenting the change OR an Affidavit certifying the change Notarized.
- Certified copy of the UK Registration Certificate showing the Change (only for
UK based registrations). .
