What is Not Registrable : 

  • Marks similar to national emblem.
  • Marks similar to a registered copy right figure, logo, character or figure. 
  • Marks containing geographical indications.
  • Marks not conforming to public ethics, moral, religion or nation’s safety regulations.

Priority under Paris Convention : Yes - within 6 months from the priority date, and priority 
document is submitted within 3 months after the end of the priority date.

Examination : Yes – formal & Substantive. 
Publication : Yes - runs for 3 months after the end of the substantive examination.

Opposition : Yes - during the publication period. 
Time Frame for Registration : About 18 months for smooth applications. 
Registration Term : 10 Years from filing date.
Renewal Term : 10 Years
Grace Period for Renewals : None

Use Requirement for filing : the mark could be used not more than 6 months before the filing date.

Cancellation : 

  1. If there is no response to official action or opposition. 
  2. If the mark is neither used nor licensed within 3 years after the registration date.

Assignments - Must Assignments be recorded ? Yes - obligatory. 
Can pending applications be Assigned ? No - Only registered marks.

Licenses - Must Licenses be recorded ? Yes - obligatory.

Can pending application be Licensed ? No - Only registered marks.

Important Notes :

  • Power of Attorney and Statement need neither notarization nor legalization. 
  • Power of Attorney and Statement should be submitted on the filing date. 
  • The Trademark Office would notify the attorney if the application lacks some particulars.
  • Meaning of the mark, if any, should be given with the application.
  • Non-Latin characters should be transliterated into Latin and the meaning thereof given.

Trademark/Service Mark Requirements

  1. Power of Attorney and Statement duly signed by the applicant.
  2. Specific description of the goods or services.
  3. 30 specimens of the mark, which measure between 2 x 2 cm and 9 x 9 cm.
  4. Priority documents in case of claiming priority.

Renewal of Trademark/Service Mark Requirements

  1. Power of Attorney and Statement duly signed by the applicant.
  2. Specific description of the goods or services.
  3. 30 specimens of the mark, which measure between 2 x 2 cm and 9 x 9 cm.
  4. Copy of the certificate.

Assignment Recordal Requirements

  1. Power of Attorney and Statement duly signed by the new owner.
  2. Deed of Assignment signed by the assignor and the assignee. This sheet should be 
    notarized and legalized to the Indonesian Embassy or Consulate.
  3. Copy of the certificate.

License Recordal Requirements

  1. Power of Attorney and Statement duly signed by the licensee.
  2. Licensing agreement between the licensor and the licensee. This sheet should be 
    notarized and legalized to the Indonesian Embassy or Consulate. 
  3. Copy of the certificate.

Change of Name/Address Requirements

  1. Power of Attorney and Statement duly signed by the new owner.
  2. Formal statement regarding the change of name or address. This sheet should be 
    notarized and legalized to the Indonesian Embassy or Consulate. 
  3. Copy of the certificate.
