Classification : Nice Classification (8th Edition) – Examiners use this only as a guideline and can deviate from the agreement; Single-Class filing.

Priority under Paris Convention : Yes - within 6 months. A foreign applicant must be a national of a WTO member state or of a country that provides reciprocal treatment concerning priority for Thai applicants.

Examination : Yes 
Publication : Yes – in the Official Gazette after examination.
Opposition : Yes – within 90 days as of publication date.
Time Frame for Registration : 12 months for smooth application.
Registration Term : 10 Years as of filing date
Renewal Term : 10 Years
Grace Period for Renewals : None
Use Requirement for filing : None

Cancellation : Yes – a registered mark can be cancelled on the following grounds:

  1. Administrative Cancellation Action (Trademark Board)
    A) Due to lack of distinctiveness.
    B) Where the Mark is prohibited from registration by Sec.8.
    C) Where the mark is identical or similar to another registered mark.
    D) Non-Renewal.
  2. Judicial Cancellation Action (Intellectual Property Court)
    A) Where a mark has become a Generic term.
    B) Better right

  1. Power of attorney duly notarized (signed before notary public).
  2. List of goods/services and classification.
  3. Twenty five specimens of the mark.
  4. Certified copy of the priority document if priority is to be claimed.

Renewal of Trademark/Service Mark Requirements

  1. Power of attorney duly notarized (signed before notary public).
  2. Details of the Mark & Classes.

Assignment Recordal Requirements

  1. Power of attorney duly notarized (signed before notary public).
  2. Details of the Mark & Classes.
  3. Assignment Deed duly legalized.

License Recordal Requirements

  1. Power of attorney duly notarized (signed before notary public).
  2. Details of the Mark & Classes.
  3. License Agreement duly legalized.

Change of Name/Address Requirements

  1. Power of attorney duly notarized (signed before notary public).
  2. Details of the Mark & Classes.
  3. Certificate showing the changes duly legalized.
